US Immigration, Business & Real Estate Attorney
Family-Based Visas
The first stage in this process is filing a Petition with US Citizenship & Immigration Services (‘USCIS’).
We assist people wishing to petition family members to immigrate to the United States. There are different types of family-based visa petition categories depending on the family relationship:
-
Immediate Relative petition: these petitions are for a spouse or child (under 21) of a US Citizen. There is no visa allocation for this category, which is why it is known as ‘immediate relative‘.
-
Family-Based Preference Categories:
-
First preference (F1) - unmarried sons and daughters, 21 years of age and older, of U.S. citizens.
-
Second preference (F2A) - spouses and children (unmarried and under 21 years of age) of lawful permanent residents.
-
Second preference (F2B) - unmarried sons and daughters, 21 years of age and older, of lawful permanent residents.
-
Third preference (F3) - married sons and daughters of U.S. citizens; and
-
Fourth preference (F4) - brothers and sisters of U.S. citizens (if the U.S. citizen is 21 years of age and older).
